Nori Lights offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. In no case shall Nori Lights, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. You agree to indemnify, defend and hold harmless Nori Lights and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. SECTION 21 - CREDIT CARD/PAYMENT DISPUTES
Nori Lights offers refunds according to our stated policies. Likewise, we do not offer refunds other than those stated in our policies. IMPORTANT INFORMATION ABOUT CREDIT CARD AND ELECTRONIC PAYMENT DISPUTES: BEFORE FILING A DISPUTE OR CLAIM, OR INITIATING A CREDIT CARD CHARGE BACK, PLEASE CALL US AT 858-444-6295 TO AVOID INCURRING CHARGE BACK/CLAIM FEES. You may call us between 9am to 5 pm Pacific Standard Time, Monday through Friday. Please allow us 3 business days to research and respond to your claim. Nori Lights/Power and Designs will always institute the appropriate civil or criminal proceedings to reclaim the debt when a customer files a fraudulent claim against Nori Lights or any of its agents or representatives, or when a customer uses a credit card chargeback procedure fraudulently or to avoid payment of a legitimate debt. If the customer makes a chargeback or files a claim on the transaction without legal justification, a charge of $300.00 will be added to the total invoice amount to recover the outstanding administration charge as well as to collect the fee charged by our merchant suppliers who issued the chargeback. An invalid or unjustified chargeback will result in Nori Lights/Power and Designs reporting the invalid or unjustified chargeback to ChargebackProtection.org which may ban you from placing orders with any business that uses ChargebackProtection.org. If the customer does not pay the entire balance within 7 days of written notice to pay the outstanding balance, Nori Lights/Power and Designs will pursue its legal remedies to recover the debt owed, including reasonable attorney’s fees and costs. Charge back rebuttals require at least 3 hours of preparation and mailing, transmission charges and other administrative costs. That is why you will be charged $300 for processing the chargeback. It is our policy to pursue our legal remedies even if we are unsuccessful on the chargeback rebuttal. If it is necessary to file a civil action against you for non payment of the product or services received, please note that we will seek recovery of the cost of the product or services, the chargeback fee of $300 for processing the chargeback, plus the cost of financial services charged to us caused by the chargeback. Customer agrees that prior to initiating any chargeback procedure, customer will first contact Nori Lights/Power and Designs in an attempt to resolve the matter at issue. If a chargeback is made by the customer and such chargeback lacks any legal justification or is found to be invalid, customer agrees to pay an administrative fee of $300.00 to the balance total amount due and owing on the purchase. Customer agrees to pay this administration charge in addition to the $15.00 fee charged by the merchant supplier, bank, card issuer or any other entity to issue a chargeback. Customer further agrees to pay reasonable attorney’s fees and costs associated with collection of the debt. Limitation of Liability Nori Lights/Power and Designs shall not be liable for any indirect or consequential loss or damage, whether for loss of profit, loss of business, depletion of goodwill or otherwise, howsoever caused, which arise out of or in connection with any contractor and or supply of goods or services by Nori Lights/Power and Designs. Nori Lights/Power and Designs shall not be liable for any financial consequence indirect or other losses suffered by the customer or any third party whether such loss arises in contract or any other way. Duty to Defend and Indemnify Nori Lights/Power and Designs Customer expressly agrees as a term of service, customer agrees to step forward and defend Nori Lights/Power and Designs in the event that a lawsuit initiated against Nori Lights/Power and Designs arising from the active or passive negligence of the customer in the use, publication or distribution of materials and services provided to customer by Nori Lights/Power and Designs. SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION? When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. SECTION 3 - DISCLOSURE We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 - SHOPIFY Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall. Payment: If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. SECTION 6 - SECURITY To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

International Shipping Fees
Customer is responsible for customs, duties, and taxes (see details below). During the check out process, international orders will be quoted a real time cost for shipping the items being purchased. Nori Lights/Power and Designs (or any of its representatives) do not set these rates. This shipping rate is the exact amount that we are billed for sending your order to the address that you provided at the time of check out. This fee is determined by, and paid to our international shipping courier. This fee covers the cost of transit only. It does not cover any additional fees that are determined and imposed by other various country's government and/or Customs agencies.
Customs, Duties, and Taxes
The recipient of an international shipment may be subject to customs brokerage fees, import duties, and taxes after the shipment reaches the destination country. Additional charges are the responsibility of the recipient because we have no control over these government-imposed charges and cannot determine what they may be. Customs policies vary greatly among countries. Please contact your local customs office for information.
To avoid a delay in receiving your order from customs:
- Provide us with a phone number where you can be reached by customs when your product arrives. This phone number will be listed on the commercial invoice so customs can reach you to clear your order.
- Please do not refuse a shipment or ignore requests from carriers regarding duty and/or tax liability charges. Be aware that most carriers will hold a shipment for 5 days after arrival in your country before they return it to the sender.
- We do not refund original shipping charges for goods that are refused for delivery at customs.
- Any orders returned, kept or lost by customs as a result of customers refusal to pay customs duty fees or import taxes will be considered forfeited by customer. No refunds, credits or exchanges can be made for orders returned due to customer failing to pay these fees to their countries customs department. Customer agrees to inquire with their customs department so that they can be aware of the cost of import fees BEFORE placing an order on our website.
Refunds and Exchanges
Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Several types of goods are exempt from being returned. Sale items, items marked down at discounted or promotional rates, items purchased as a pre-order, as well as items purchased as a back-order, items returned to us without a RMA number (which can be obtained by contacting us via email or phone), used items, electronic devices with the battery safety "PULL" tab removed, products that have had the seal or "Quality Assurance Tab" (adhesive strip) removed or broken, custom orders, items that differ from what was originally ordered and then requested to replace original order items regardless of equal, greater or lesser price, and products that do not contain all included pieces and components originally packaged together as a whole product, returned items that do not include either original invoice, packing slip, or original order confirmation, and orders associated with invalid/fraudulent chargeback requests/actions cannot be returned. We also do not accept products that are shipped and/or returned to us with out the customer first attempting to contact us either by phone or email. Failing to contact and inform us of your return, and failure to request and include an RMA number for your return will result in the denial of your refund request. The customer is responsible for the cost of shipping their return. It is advisable to select a shipping service that includes a updated tracking service.
Additional non-returnable items:
Products that have been modified or tampered with
Products purchased as "Pre-order" (or back-order), custom orders, upgrades, replacing one or more items with alternative products, and products modified from the standard form, requested or accepted by customer
Partial returns - If you purchase multiple products/items together, all products/items purchased under that transaction must be returned together and complete when requesting a refund.
To complete your return, we require your returned item to include all three of the A, B, and C document types listed below.
A. Receipt or proof of purchase, invoice, or printed copy of your order confirmation that was originally emailed to you upon placing your order.
B. All printed and paper materials/documents that were included or bundled with your order
C. Typed or written notice stating your name, your order number, your original purchase date, a contact phone number, your RMA number provided by us at your request, and your reason for returning the product and requesting a refund.
REFUNDS (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
A 15% restocking fee will be applied to all approved returns/refunds.
The original cost to ship your order is non-refundable.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
Pre-Orders, Back-Orders, and Any Items that are Manufactured/Assembled Custom Per Order
Refunds are not offered for custom, pre-ordered, back-ordered, or upgraded orders. When pre-ordering or placing an order for an item on back-order, all sales are final. The funds collected for pre-order or out of stock items (back-order) are immediately used to fund the production and manufacturing of your order and associated expenses. We do not offer cancellations or refunds on pre-ordered or back-ordered items. Due to the complexities of the manufacturing process and available shipping methods, estimated restocking dates may be subject to change as a result of events beyond our control. The possibility of reasonably extended delivery dates should be understood and accepted prior to placing your order, as our no cancellation policy will still be upheld in order to prevent further delays and complications in fulfilling other orders as well.
Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at email@example.com.
SALE ITEMS (if applicable)
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.
EXCHANGES (if applicable)
We only replace items if they are defective or damaged due to manufacturer defect. We do not offer exchanges or warranty's on items that have been damaged by the user due to misuse, unauthorized modifications, or used for purposes other than intended by the manufacturer.

To return your product, after you have received an RMA number, you should mail your product along with all required documents and materials listed above to: Nori Lights, 6 Sunset Point, Alpine, CA. 91901 USA. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.
We advise you to consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item. Shipping and delivery dates associated with pre-ordered items are not guaranteed.
Due to the complexity of manufacturing and production, the actual shipping and delivery dates may vary.
The dates listed at the time of pre-order are only estimates and may change throughout the production process.
CREDIT CARD DISPUTES
Nori Lights offers refunds according to our stated policies. Likewise, we do not offer refunds other than those stated in our policies.
IMPORTANT INFORMATION ABOUT CREDIT CARD DISPUTES: BEFORE INITIATING A CREDIT CARD CHARGE BACK, PLEASE CALL US AT 858-444-6295 TO AVOID INCURRING CHARGE BACK FEES. You may call us between 9am to 5 pm Pacific Standard Time, Monday through Friday. Please allow us 3 business days to research and respond to your claim. Nori Lights/Power and Designs will always institute the appropriate civil or criminal proceedings to reclaim the debt when a customer uses a credit card chargeback procedure fraudulently or to avoid payment of a legitimate debt. If the customer makes a chargeback without legal justification, a charge of $300.00 will be added to the total invoice amount to recover the outstanding administration charge as well as to collect the fee charged by our merchant suppliers who issued the chargeback. An invalid or unjustified chargeback will result in Nori Lights/Power and Designs reporting the invalid or unjustified chargeback to ChargebackProtection.org which may ban you from placing orders with any business that uses ChargebackProtection.org. If the customer does not pay the entire balance within 7 days of written notice to pay the outstanding balance, Nori Lights/Power and Designs will pursue its legal remedies to recover the debt owed, including reasonable attorney’s fees and costs. Charge back rebuttals require at least 3 hours of preparation and mailing, transmission charges and other administrative costs. That is why you will be charged $300 for processing the chargeback. It is our policy to pursue our legal remedies even if we are unsuccessful on the chargeback rebuttal. If it is necessary to file a civil action against you for non payment of the product or services received, please note that we will seek recovery of the cost of the product or services, the chargeback fee of $300 for processing the chargeback, plus the cost of financial services charged to us caused by the chargeback. Customer agrees that prior to initiating any chargeback procedure, customer will first contact Nori Lights/Power and Designs in an attempt to resolve the matter at issue. If a chargeback is made by the customer and such chargeback lacks any legal justification or is found to be invalid, customer agrees to pay an administrative fee of $300.00 to the balance total amount due and owing on the purchase. Customer agrees to pay this administration charge in addition to the $15.00 fee charged by the merchant supplier, bank, card issuer or any other entity to issue a chargeback. Customer further agrees to pay reasonable attorney’s fees and costs associated with collection of the debt. Limitation of Liability Nori Lights/Power and Designs shall not be liable for any indirect or consequential loss or damage, whether for loss of profit, loss of business, depletion of goodwill or otherwise, howsoever caused, which arise out of or in connection with any contractor and or supply of goods or services by Nori Lights/Power and Designs. Nori Lights/Power and Designs shall not be liable for any financial consequence indirect or other losses suffered by the customer or any third party whether such loss arises in contract or any other way.
Duty to Defend and Indemnify Nori Lights/Power and Designs Customer expressly agrees as a term of service, customer agrees to step forward and defend Nori Lights/Power and Designs in the event that a lawsuit initiated against Nori Lights/Power and Designs arising from the active or passive negligence of the customer in the use, publication or distribution of materials and services provided to customer by Nori Lights/Power and Designs.
